Pot dollars are starting to roll in in Washington state, marijuana reform bills filed in Arizona, Illinois delays dispensary applications without explanation, Colorado wants to grow research marijuana at colleges, and more. Let’s get to it:

Washington State Did $64 Million in Pot Sales in Slow Roll-Out First Year. Legal marijuana commerce has been slow out of the gate in Washington, thanks to regulatory hurdles and supply shortages, but still rang up $64 million in sales by year’s end. Some 99 retail outlets have been licensed (although that doesn’t mean they are operating) out of the 331 envisioned by the state Liquor Control Board, which is in charge of legal marijuana. As legal pot settles in, looks for this year’s numbers to be significantly greater.

Arizona Lawmaker Files Legalization Bill. Rep. Mark Cardenas (D-Phoenix) has filed a bill that would legalization the possession of up to an ounce of weed and allow for it to be sold through state-regulated retail outlets. The bill is House Bill 2007. Cardenas admits passage is unlikely, so he has a back-up plan: His House Bill 2006 would simply decriminalize the possession of up to an ounce.

Medical Marijuana

Illinois Misses Deadline on Issuing Medical Marijuana Licenses. State officials admitted Wednesday afternoon that they had missed their self-imposed deadline to begin issuing dispensary and cultivation licenses before the end of 2014. But they didn’t say why or when they would be ready. Here is the statement from the Department of Health: “We are strongly committed to bringing relief to thousands of people across the state and ensuring Illinois is the national model for implementing medical cannabis. We are working hard to make sure this is done right. We are conducting a comprehensive review of every cultivation center and dispensary applicant to ensure that only the most qualified are approved for this important program. We will announce the recipients when this important review is finished.”

Colorado Seeking Federal Okay for State Colleges to Grow Marijuana.In a letter sent last month, the state attorney general’s office asked federal health and education officials to allow state institutions of higher learning to “obtain marijuana from non-federal government sources.” The letter was sent under a law passed last year requiring state officials to ask the federal government to allow colleges and universities “to cultivate marijuana and its component parts.” “Current research is riddled with bias or insufficiencies and often conflict with one another,” reads the letter, written by deputy attorney general David Blake. “It is critical that we be allowed to fill the void of scientific research, and this may only be done with your assistance and cooperation.” Don’t hold your breath, though.

Drug Treatment and Recovery

Text Available for Federal Comprehensive Addiction and Recovery Act. The full text of the act, HR 5845, is now available online. The bill, sponsored by Rep. James Sensenbrenner (R-WI), would authorize the awarding of grants for prevention and education, treatment alternatives to incarceration, expansion of law enforcement use of the overdose reversal drug naloxone, as well as “evidence-based opioid and heroin treatment and interventions demonstrations” and “criminal justice medication-assisted treatment and intervention demonstrations.” The bill currently has six cosponsors—three Republicans and three Democrats—and has been assigned to the House Judiciary, Energy and Commerce, and Education and Workforce committees. Australian Cops Using Drug Dogs Bust 214 People at New Year’s Dance Festival. Who let the dogs out? New South Wales police did, that’s who. They reported arresting 214 people at the “Fuzzy Field Day 2015” electronic music festival in Sydney yesterday after drug dogs alerted on them. Three other people were arrested on drug trafficking charges.

Seattle City Attorney Wants Marijuana Vapor Lounges. In a new memo on marijuana policy, City Attorney Peter Holmes is calling for the legalization of pot vapor lounges in the city. “Single family homeowners have a legal place to consume marijuana; others however, such as out-of-town visitors, the homeless, and renters and condominium owners whose buildings do not permit marijuana use, have fewer options,” he noted in the memo. “You can enforce that law much better if you, at the same time, provide an outlet for that demand,” Holmes said. The lounges would be open only to those 21 and over, require customers to bring their own weed, and would only allow vaping, not smoking. Such a move would require the approval of the city council and the city health department.

Virginia Poll Finds Majority Support for Decriminalization, Medical Marijuana. A Public Policy Polling survey commissioned by the Marijuana Policy Project finds that 74% of respondents supported allowing medical marijuana and 60% supported decriminalization. The poll also had a near-majority for legalization, with 49% in favor and 44% opposed.

California Activists Set First Meeting for 2016 Initiative. The California Coalition for Cannabis Policy Reform will kick off the effort to legalize pot in the state in 2016 with a meeting in Oakland this Friday. The meeting will be a seminar examining lessons from the successful initiative efforts in Oregon, Washington, and the District of Columbia, as well as the roll-out of marijuana commerce in Colorado. Medical Marijuana

Iowa Pharmacy Board Votes to Reschedule CBD, But Not Marijuana. The state Board of Pharmacy voted Monday to move cannabidiol (CBD) from Schedule I to Schedule II, but not marijuana. The board was acting on a petition from long-time activist Carl Olsen, who sought to have the whole plant rescheduled. But the board wasn’t ready to do that. Olsen says while it isn’t what he was asking for, it is a step in the right direction.

Sentencing

Washington State Defelonization Bill to Get Hearing. A bill that would make simple drug possession a misdemeanor instead of a felony will get a public hearing in the House Public Safety Committee on January 16. The bill is House Bill 1024, introduced by Rep. Sherry Appleton (D-Poulsbo), and is estimated to save the state millions in incarceration costs each year if passed. Fourteen other states have defelonized drug possession, with California being the most recent. Voters there approved a defelonization initiative in November.

Law Enforcement

The extent of the thievery and corruption is mind-blowing. Well worth the read.

International

“Illogical and Punitive Drug Policy” to Blame for British Ecstasy Deaths, Prominent Critic Says. Dr. David Nutt, the former head of the Advisory Commission on the Misuse of Drugs who was fired for failing to toe the government’s hard line of drug policy, has blamed that hard-line policy for the drug overdose deaths of four men in the past few days. The men thought they were taking Ecstasy, but a British government crackdown on the drug has led to it being substituted by a more lethal substance, PMA. That’s the “illogical and punitive drug policy,” Nutt was referencing. “The emergence of the more toxic PMA following the so-called ‘success’ in reducing MDMA production is just one of many examples of how prohibition of one drug leads to greater harm from an alternative that is developed to overcome the block,” he added.

Mexican Army Kills Nine Civilians in Cartel-Plagued Michoacan. Nine civilians have been killed by Mexican soldiers in the town of Apatzigan, Michoacan, after the army tried to take control of city hall, which had been held for days by armed civilians. It’s not clear who exactly was involved, but the western Mexican state has been plagued for years by violent drug trafficking organizations, and more recently, by armed vigilantes fighting the cartels.

Iran Greets New Year By Hanging 13 Drug Offenders. New Year’s Day saw 13 drug offenders hanged in Iranian prisons, including four women. All had been convicted of drug trafficking. Iran hanged hundreds of drug traffickers last year, and it looks like it’s off to a quick start this year, too.

A California tribe looks to be the first to grow marijuana, DC councilmembers move ahead with plans to tax and regulate pot, key congressional committee chairs call for asset forfeiture reform, an omnibus heroin bill is on the move in Kentucky, and more. Let’s get to it:

Milwaukee Aldermen Want to Make Pot Ticket Fine $5 or Less. If you get caught with pot in Milwaukee right now, you face a fine of between $250 and $500—and a trip to jail if you don’t pay the fine. Two Aldermen think that’s too much. Nik Kovac and Ashanti Hamilton are proposing lowering the fine to $5 or less. We are effectively trying to eliminate any of these tickets,” Kovac said, citing racial disparities in marijuana arrests. Although the city’s black and white populations are roughly equal, five times as many black people were arrested for pot possession last year as white people.

Half of Michiganders Support Marijuana Legalization. Michigan is evenly divided on marijuana legalization, with 50% saying they would support an initiative allowing pot possession by adults and taxable sales at state-regulated stores, and 46% saying they opposed such an idea. The figures come from a new poll conducted by EPIC-MRA of Lansing. A similar poll last year had support at 47%. The trend is upward, but the numbers aren’t high enough to excite deep-pocketed potential initiative backers; the conventional wisdom is that initiatives should be polling at 60% or more when the campaign begins

DC Councilmembers File Bill to Tax and Regulate Marijuana. In a pointed message to the Congress, DC councilmembers last week introduced a bill that would tax and regulate marijuana sales in the nation’s capital. The move comes despite passage of a federal spending bill that included an amendment barring the District from spending local or federal funds to implement such a law. Councilmember David Grosso and three colleagues have introduced the Marijuana Legalization and Regulation Act of 2015 (B21-0023), which would create a framework for a legal marijuana industry, complete with licensed cultivators, product manufacturers, retail stores, and testing labs.

Washington State Legislators Face Plethora of Pot Bills. Voting to legalize marijuana in 2012 was not the end for marijuana policy at the state legislature, but a new beginning. This week, at least seven marijuana-related bills have been filed as the session gets underway. A pair of bills seeks to resolve the problems with the fit between recreational and medical marijuana, another bill would raise the excise tax, yet another addresses organ transplant eligibility, while another would bar open containers in moving vehicles. A Second Ohio Legalization Initiative Campaign Emerges. Ohioans to End Prohibition has become the second group to plan a 2016 legalization initiative in the Buckeye State. The group is finalizing language for its Cannabis Control Amendment within the next few weeks. Already out of the gate is Responsible Ohio, whose End Ohio Cannabis Prohibition Act (EOCPA) would set up 10 authorized marijuana growing locations around the state.

Northern California Tribe Could Be First to Grow Pot. The Pinoleville Pomo Nation in Mendocino County, California, said last Thursday it had signed a contract to grow thousands of marijuana plants on its 99-acre Rancheria (reservation) north of Ukiah. The Justice Department recently gave the okay for marijuana operations on tribal lands, and it looks like the Pomos are first off the blocks.

Medical Marijuana

Florida Medical Marijuana Initiative is Back. Proponents of last year’s failed medical marijuana initiative have filed a rewritten ballot measure aimed at 2016. “The language and the essence of the amendment is essentially the same,” said John Morgan, the Orlando attorney who chairs People United for Medical Marijuana, and the chief financer of the legalization drive. “What I would say is that we have tweaked or clarified positions that were constantly brought up by our opposition to help us talk more freely about the real issue, which is the legalization of medical marijuana.”

Poll Finds Georgians Back Allowing CBD Cannabis Oil. Some 84% of Georgians support the legalization of low-THC, high-CBD cannabis oils to treat medical conditions, according to a new Atlanta Journal-Constitution poll. The poll also found that when it came to legalizing marijuana for recreational use, Georgians were split almost evenly, with 49% saying legalize it and 48% saying don’t. 

Heroin

Kentucky Omnibus Heroin Bill Passes Senate. A multi-pronged bill designed to address the state’s heroin problem passed the Senate in three days. The measure would increase treatment, prevention, and overdose prevention measures, but would also increase penalties for some heroin offenses. Democrats in the House said they will pass a similar measure, but probably without the mandatory minimum prison sentences approved in the Senate version.

International

Geneva Wants to Legalize the Marijuana Business. A year after Switzerland decriminalized pot possession, the canton on Geneva is thinking about legalizing the pot trade in a bid to undermine the black market. The canton’s multi-party Advisory Commission on Addiction has urged the regional government to seek federal government approval of a pilot legalization program. The commission is recommending something akin to the Spanish model, where home cultivation is tolerated and private cannabis clubs offer smoking space and weed for sale.

Brazil Justice Minister Says No Marijuana Legalization. Justice Minister Jose Eduardo Cardozo said Sunday that Brazil has no intention of following neighboring Uruguay down the path of pot legalization. “Legalization of drugs is not a part of the government’s plans,” he said. While reform advocates have cited prison overcrowding as a reason to legalize pot, Cardozo said the answer to overcrowding is not to stop arresting marijuana offenders, but to build more prisons.

Chile Authorizes Second Medical Marijuana Grow. Government officials have given the okay to a Chilean concern to grow a medical marijuana crop, the second time such a crop has been approved in the country. Agrofuturo will begin industrial production at its facility in the city of Los Angeles, south of Santiago. In September, the government granted approval to the Daya Foundation to grow the country’s—and the continent’s—first legal medical marijuana crop. 

Marijuana Likely To Be Decriminalized in D.C.

Before long, smoking a joint in the nation’s capital might get you in even less trouble than parking on the wrong side of the street on street-cleaning day.

Ten of 13 members of the D.C. Council and Mayor Vincent C. Gray (D) have endorsed a plan to make small-time marijuana possession a civil rather than a criminal offense. That means recreational cannabis users wouldn’t face arrest, charges or jail time — any of which can destroy their lives — as long as they aren’t caught with more than an ounce of the drug. Instead, they would have to pay a fine, perhaps as low as $25. (The mayor also wants criminal penalties to remain for anyone caught using it in public.)

Much of the debate over the idea has focused on an American Civil Liberties Union report that suggests that the District and many other jurisdictions enforce their anti-marijuana laws unfairly, disproportionately arresting African American suspects. On these pages, Police Chief Cathy L. Lanier pushed back, insisting that factors such as a geographic concentration of tips about marijuana users, not biased policing, are responsible for the city’s arrest figures.

That debate does not need to be resolved to conclude that maintaining criminal penalties for small-time users of any race doesn’t make sense.

Enforcing criminal penalties against those who aren’t involved in trafficking or selling the drug would be too harsh and a waste of government resources. As it stands, very few people in the District are prosecuted for possessing less than an ounce of marijuana, unless there are other charges to go along with it. But even an arrest can make it difficult to find a good job.

Refraining from enforcing criminal penalties, on the other hand, would promote disrespect for the law.

An all-around better policy, long championed by District lawyer Paul Zukerberg, would be to slap small-time users with a civil fine, which is a measured way to send a message that the government does not condone or tolerate marijuana use. No one’s life would be permanently marred by getting caught with a joint. But violators would still have to pay, literally. In that vein, we would suggest that $25 — a smaller fine than that attached to low-level parking violations — is too modest a penalty. Maryland lawmakers considered setting a $100 fine this year, the same level that New York state approved last year. That sounds like the right size.

Attitudes about marijuana are changing, and quickly. A recent Gallup poll found that an astonishing 58 percent of Americans now favor legalizing the drug. Colorado and Washington state have both tried to do just that by changing their drug laws. Federal law still treats marijuana as an illicit substance, but Attorney General Eric H. Holder Jr. announced a policy this year that aims federal resources at high-level offenders. And now the District government is poised to join the 15 states that have decriminalized small-time pot possession.

Of all the official reactions to changing mores on marijuana, decriminalization is the best.

Bowing To The Inevitable On Pot

Justice Dept.  Right Not to Challenge State Laws Legalizing Marijuana

Bowing to changing times and admittedly limited prosecutorial resources, the Justice Department announced last week that it would not seek to block state laws legalizing marijuana for medical and recreational use.  The declaration represented a major reversal from the department’s previous position that marijuana is a dangerous drug that the government is obligated to go after under federal law regardless of what state legislatures do.  The policy shift unveiled Thursday inevitably will change the conversation about marijuana use in America, and it’s likely to have important legal and social consequences as well going forward, not all of them predictable.  But it was nevertheless the right decision.

Eighteen states, including Maryland, and the District of Columbia now have laws decriminalizing possession of small amounts of pot for medicinal purposes.

Two more, Colorado and Washington, recently legalized the drug for recreational use as well.  Despite the fact that federal law has not changed, the Justice Department clearly saw the handwriting on the wall.  Henceforth, marijuana policy increasingly will be made in state capitals rather than by lawmakers in Washington, with the federal government’s role largely reduced to oversight rather than enforcement.

Proponents of legalizing marijuana hailed the announcement as a major step toward ending all restrictions on the drug.  That’s unlikely to happen any time soon, however, given that President Barack Obama has said he opposes lifting the federal ban on pot, and Congress is unlikely to push the issue.

The more probable outcome of the department’s shift in policy is that the country will embark on something in the nature of a national experiment regarding marijuana use and its public health and safety consequences.  Eventually, that may lead to some kind of consensus about aspects of the drug’s use that should be regulated or controlled even if it is no longer banned.

Some outlines of such a possible consensus are already coming into view.  It’s inconceivable, for instance, that even states that decriminalize the drug for medical or recreational purposes ( or both ) wouldn’t impose strict limits to keep it out of the hands of children, similar to the restrictions that now apply to alcohol and tobacco sales.

Similarly, there would also have to be some kind of uniform regulatory system to protect consumers against tainted or counterfeit products, and rules prohibiting false or misleading advertising as well as guidelines for when and where such products can be marketed.  These are all problem states would have to work out for themselves, with the federal government keeping a close eye on whether they are effective in terms of public health and safety.

Obviously, the Justice Department also has a huge interest in seeing to it that any relaxation in state drug laws doesn’t open the door for criminal organizations to profit from illegal sales of smuggled contraband.  One of the arguments often given in favor of legalization is that it would allow states to increase revenues by taxing marijuana sales.

But that supposed boon would quickly evaporate if state and federal authorities allowed a flourishing black market in the drug to continue.

And while supporters of legalization claim that lifting the ban on marijuana would drive today’s bad actors out of business, the lessons gained from past experience of efforts aimed at clamping down on illegal sales of cigarettes and booze are hardly encouraging.

Still, there’s no doubt that Americans’ attitudes toward marijuana are changing rapidly.

Many experts, including Attorney General Eric Holder, now recognize that the so-called “war on drugs” the nation has waged over the last three decades has been in many ways counterproductive, filling state and local prisons with hundreds of thousands of low-level, nonviolent drug offenders who then become a permanent drag on the economy when their criminal records prevent them from obtaining gainful employment on release.

The relentless focus on arresting and imprisoning people for possession of small amounts of marijuana has torn apart millions of minority and low-income families and shredded the social fabric of their communities.

America obviously can’t continue along that self-destructive path, but the drive for change will have to come from the states rather than from the federal government.  The Justice Department has now acknowledged that it needs to get out of the way so that can happen, and one can only hope the conversation about pot that ensues will produce a way out of the country’s current dilemma sooner rather than later.

D.C. Council Bill Seeks To Decriminalize MJ

Marijuana advocates in the District have a few friends on the D.C. Council. D.C. Councilmember Tommy Wells (D-Ward 6) unveiled a bill Wednesday morning that would decriminalize possession of small amounts of marijuana, according to WUSA9.

Under the bill, anyone caught with less than one ounce of marijuana would face a civil penalty of a $100 fine. Under current law, possession of marijuana is a misdemeanor offense; first-time offenders face up to six months in prison and a $1,000 fine.

At a press conference, Wells said that the purpose of decriminalization is to save youths caught with marijuana from losing employment opportunities in the future.

“Once you have a marijuana charge on your record, you cannot participate in certainly the construction boom that is happening all over the city, and it works to stigmatize people … and it disadvantages them from jobs,” Wells said, according to The Washington Post.

A report by the American Civil Liberties Union in June found that D.C. leads the nation in marijuana possession arrests per capita, with a rate more than three times higher than the national average. The ACLU also found that nationally African Americans are 3.73 times more likely to be arrested for marijuana possession than whites, even though the two groups use marijuana at a nearly equal rate.

The proposed legislation was hailed by marijuana advocacy organizations.

“It is time to adopt a more sensible marijuana policy in our nation’s capital, and that is what Councilman Wells has proposed,” said Morgan Fox, a spokesman for the Marijuana Policy Project, in a press release.

According to surveys, the majority of D.C. residents support decriminalizing and legalizing marijuana. A poll conducted by Public Policy Polling in April found that 75 percent of D.C. residents support decriminalizing possession of small amounts of marijuana and that 63 percent support legalizing and taxing marijuana for those 21 and older.

Mayor Vincent Gray, however, has said that the District should focus on the implementation of its medical marijuana program before considering the decriminalization of marijuana more broadly.

Council Chairman Phil Mendelson (D) is also skeptical of decriminalizing marijuana, citing federal concerns.

“I don’t think it’s the right time,” Mendelson told the Post in May, adding, “I don’t think decriminalization of marijuana will go over easily with Congress.”

Wells introduced the legislation with Councilmember Marion Barry (D-Ward 8) and six additional co-sponsors, including Councilmember David Grosso (I-At Large), who has said he would support a bill to legalize marijuana.

If the District does decriminalize marijuana for personal use, it would join 14 states that already have similar laws on the books.

Blacks Are Singled Out for Marijuana Arrests

Black Americans were nearly four times as likely as whites to be arrested on charges of marijuana possession in 2010, even though the two groups used the drug at similar rates, according to new federal data.

This disparity had grown steadily from a decade before, and in some states, including Iowa, Minnesota and Illinois, blacks were around eight times as likely to be arrested. During the same period, public attitudes toward marijuana softened and a number of states decriminalized its use. But about half of all drug arrests in 2011 were on marijuana-related charges, roughly the same portion as in 2010.

Advocates for the legalization of marijuana have criticized the Obama administration for having vocally opposed state legalization efforts and for taking a more aggressive approach than the Bush administration in closing medical marijuana dispensaries and prosecuting their owners in some states, especially Montana and California.

The new data, however, offers a more nuanced picture of marijuana enforcement on the state level. Drawn from police records from all 50 states and the District of Columbia, the report is the most comprehensive review of marijuana arrests by race and by county and is part of a report being released this week by the American Civil Liberties Union. Much of the data was also independently reviewed for The New York Times by researchers at Stanford University.

“We found that in virtually every county in the country, police have wasted taxpayer money enforcing marijuana laws in a racially biased manner,” said Ezekiel Edwards, the director of the A.C.L.U.’s Criminal Law Reform Project and the lead author of the report.

During President Obama’s first three years in office, the arrest rate for marijuana possession was about 5 percent higher than the average rate under President George W. Bush. And in 2011, marijuana use grew to about 7 percent, up from 6 percent in 2002 among Americans who said that they had used the drug in the past 30 days. Also, a majority of Americans in a Pew Research Center poll conducted in March supported legalizing marijuana.

Though there has been a shift in state laws and in popular attitudes about the drug, black and white Americans have experienced the change very differently.

“It’s pretty clear that law enforcement practices are not keeping pace with public opinion and state policies,” said Mona Lynch, a professor of criminology, law and society at the University of California, Santa Cruz.

She added that 13 states have in recent years passed or expanded laws decriminalizing marijuana use and that 18 states now allow it for medicinal use.

In the past year, Colorado and Washington State have legalized marijuana, leaving the Justice Department to decide how to respond to those laws because marijuana remains illegal under federal law.

The cost of drug enforcement has grown steadily over the past decade. In 2010, states spent an estimated $3.6 billion enforcing marijuana possession laws, a 30 percent increase from 10 years earlier. The increase came as many states, faced with budget shortfalls, were saving money by using alternatives to incarceration for nonviolent offenders. During the same period, arrests for most other types of crime steadily dropped.

Researchers said the growing racial disparities in marijuana arrests were especially striking because they were so consistent even across counties with large or small minority populations.

The A.C.L.U. report said that one possible reason that the racial disparity in arrests remained despite shifting state policies toward the drug is that police practices are slow to change. Federal programs like the Edward Byrne Justice Assistance Grant Program continue to provide incentives for racial profiling, the report said, by including arrest numbers in its performance measures when distributing hundreds of millions of dollars to local law enforcement each year.

Phillip Atiba Goff, a psychology professor at the University of California, Los Angeles, said that police departments, partly driven by a desire to increase their drug arrest statistics, can concentrate on minority or poorer neighborhoods to meet numerical goals, focusing on low-level offenses that are easier, quicker and cheaper than investigating serious felony crimes.

“Whenever federal funding agencies encourage law enforcement to meet numerical arrest goals instead of public safety goals, it will likely promote stereotype-based policing and we can expect these sorts of racial gaps,” Professor Goff said.

Americas Coalition Suggests MJ Laws Be Relaxed

A comprehensive report on drug policy in the Americas released Friday by a consortium of nations suggests that the legalization of marijuana, but not other illicit drugs, be considered among a range of ideas to reassess how the drug war is carried out.

The report, released by the Organization of American States walked a careful line in not recommending any single approach to the drug problem and encouraging “flexibility.”

Prompted by President Juan Manuel Santos of Colombia at the Summit of the Americas last year to answer growing dissatisfaction and calls for new strategies in the drug war, the report’s 400 pages mainly summarize and distill previous research and debate on the subject.

But the fact that it gave weight to exploring legalizing or de-penalizing marijuana was seized on by advocates of more liberal drug use laws as a landmark and a potential catalyst for less restrictive laws in a number of countries.

“This takes the debate to a whole other level,” said Ethan Nadelmann, executive director of the Drug Policy Alliance, which advocates more liberal drug use laws. “It effectively breaks the taboo on considering alternatives to the current prohibitionist approach.”

The report said “the drug problem requires a flexible approach,” and “it would be worthwhile to assess existing signals and trends that lean toward the decriminalization or legalization of the production, sale and use of marijuana.

“Sooner or later decisions in this area will need to be taken,” it said. “On the other hand, our report finds no significant support, in any country, for the decriminalization or legalization of the trafficking of other illicit drugs.”

Some analysts interpreted the inclusion of decriminalization as a thumb in the eye to the United States, the country with the heaviest drug consumption and one that has spent several billion dollars on drug interdiction in the Americas, only to find that marijuana and cocaine continue to flow heavily and that violence has surged in Mexico and Central America as the drugs move north.

The report comes two weeks before an O.A.S. meeting in Guatemala, whose president has been open to legalizing marijuana and where the central topic is drug policy in the hemisphere. Uruguay’s president has put forward a plan for the government to legalize and regulate the sale of marijuana.

“The region’s leaders expressed their frustration with the limits and exorbitant costs of current policies and their hunger for a fuller, more creative debate,” said John Walsh, a drug policy analyst at the Washington Office on Latin America, a human rights group.

But the United States has so far rejected legalization as a solution to drug violence.

A State Department spokesman, William Ostick, said the report would be carefully reviewed and discussed with fellow O.A.S. members in Guatemala.

“We look forward to sharing our latest research and experiences on drug prevention and treatment, and to strengthening operational law enforcement cooperation with our partners around the globe in support of our common and shared responsibility for the world drug problem,” he said. “We know other leaders will similarly bring their own data, and anticipate a productive and useful dialogue.”

Kevin Sabet, director of the Drug Policy Institute at the University of Florida, said advocates of drug liberalization were overplaying the significance of the report, which he said contained a lot the Obama administration would agree with.

He said a discussion of legalization was only natural, particularly since two American states, Washington and Colorado, have moved in that direction.

But the report, he said, also suggested that countries in the hemisphere needed to redouble their efforts to fight the impunity of drug gangs, something often overlooked or played down in the debate on the war on drugs. The report notes that drug organizations have atomized into a range of gangs carrying out kidnapping, extortion and other crimes.

“Institutions in the drug-producing nations are going to have to change the way they do business,” Mr. Sabet said. “You cannot only rely on reducing demand and ignore deep-seated institutional problems.”

Mr. Santos, in accepting the report in Bogota, said more study was needed. “Let it be clear that no one here is defending any position, neither legalization, nor regulation, nor war at any cost,” he said. “What we have to do is use serious and well-considered studies like the one the O.A.S. has presented us with today to seek better solutions.”

Is Marijuana Booming Among Boomers?

Like many of her peers, Zoe Helene, 48, smoked marijuana in her early 20s but gave it up as her career in the digital world took off in the 1990s. Today the multidisciplinary artist and environmental activist lives in Amherst, Mass., and is building a global network of trailblazers called Cosmic Sister. Since she married an ethnobotanist in 2007, she has returned to using cannabis occasionally — “as a tool for evolving and expanding my psyche.”

Helene is among a group of women that Marie Claire magazine has dubbed “Stiletto Stoners — card-carrying, type-A workaholics who just happen to prefer kicking back with a blunt instead of a bottle.” She’s also one of a growing legion of boomers who are returning to marijuana now that the stigma and judgment (and laws) surrounding its use are becoming more lax.

Massachusetts, which decriminalized pot in 2008, became the 18th state to legalize medical marijuana, last year. In the 2012 presidential election, which New York Times columnist Timothy Egan called America’s “cannabis spring,” Colorado and Washington voters legalized recreational use, launching weed into the national spotlight and spawning a flurry of marijuana initiatives. Since then, decriminalization bills have been introduced in 10 additional states, and legalization is being considered in 11 states and Puerto Rico.

This trend, along with decriminalization in cities like Chicago, Boston, New York and Denver, has removed a major “barrier to entry” for law-abiding citizens who would use cannabis as medicine or a substitute for alcohol. No longer worried about breaking the law or having their kids discovering their “dirty little secret,” many boomers are returning to a substance they once enjoyed. Others, who never stopped smoking, are coming out of the closet (or the garage) about their use.

The Return of Reefer

While boomers looking for stress relief turn to exercise, yoga, meditation or religion, plenty relax with alcohol or pharmaceuticals. For those who don’t drink (or can’t anymore for health reasons) or take prescription drugs but still want to unwind at the end of the day, laxer laws and attitudes have made marijuana acceptable.

Many respected doctors, homeopaths and naturopaths tout cannabis as natural medicine for a range of conditions, both physical and mental — especially when it’s ingested by means other than smoking. And with the rise of medical marijuana and legal dispensaries, adults don’t have to resort to clandestine meetings on street corners with black market strangers. They can with a prescription walk into a legitimate business establishment and choose from a variety of strains with the help of a “bud tender.”

‘Everybody Smokes Dope After Work’

Clearly there’s been a sea change. In 1969, 84% of all Americans opposed legalizing marijuana. In April 2013, Pew Research found that for the first time in more than four decades of polling on the issue, more Americans than not (52%) want marijuana to be legal. And that’s not just college kids: Among boomers the number is only slightly lower (50%).

A segment of the boomer generation never stopped smoking pot, but many did. In the 1980s, while starting families and building careers, they were influenced by the zeitgeist: Nancy Reagan’s “Just Say No” campaign and the Drug Abuse Resistance Education program, known as DARE, in their kids’ schools. People didn’t want to be associated with the stoner caricatures they saw depicted in movies, like Sean Penn’s iconic Jeff Spicoli inFast Times at Ridgemont High.

President Bill Clinton’s confession that he had smoked marijuana once but “didn’t inhale” did little to encourage open use. Contrast that with President Barack Obama’s statement that not only did that he inhale frequently but “that was the point.”

Legalized marijuana is gathering increasingly high-profile support. Last year chef, author and TV personalityAnthony Bourdain told The New York Times that “everybody smokes dope after work.” And a host of respected public figures — including Paul Volcker, Deepak Chopra, Michael Pollan and PBS’s Rick Steves — have been vocal advocates for legalization.

Another sign of the changing times is the proliferation of marijuana lifestyle stories in the media. In February, The New York Times Style section ran an article on marijuana etiquette, soliciting “an Emily Post to hack a pathway through this fuggy thicket, particularly given pot’s increased presence in the mainstream.”

The Cannabis Closet: Firsthand Accounts of the Marijuana Mainstream, published in 2010 by The Dish, surprised a lot of people with its candid testimonials from pot-smoking corporate executives, government officials and responsible parents.

Pot Prescriptions

Not all the rebudding boomers are coming back for recreational purposes. A large segment isn’t after the buzz but is using marijuana for a panoply of health issues. In the 19 states (plus the District of Columbia) where medical marijuana is legal, it’s being prescribed to alleviate symptoms associated with cancer, glaucoma, gastrointestinal disorders, arthritis, multiple sclerosis, Crohn’s disease, AIDS, migraines and chronic pain and countless other maladies. Some studies show that it might even help prevent Alzheimer’s disease and fight tumors.

Steve DeAngelo, 55, executive director of Harborside Health Center, which operates dispensaries in Oakland and San Jose, believes marijuana can be “part of a more holistic approach” to health care. Many of his clients suffering from insomnia, anxiety or lowered libido are using cannabis as an alternative to “pharmaceuticals that come with a list of side effects reading like something out of a Stephen King novel,” he says.

Medical marijuana entered the national consciousness in 1991, when San Francisco physicians were first allowed to prescribe it. Five years later California voters approved the first statewide medical marijuana laws. (Interestingly, marijuana was listed in the United States Pharmacopeia from 1850 until 1942 and wasn’t illegaluntil the Marihuana Tax Act of 1937. The U.S. government categorized it a Schedule 1 substance without medicinal value in 1970.)

Like a slow train gathering steam, other states followed California’s lead. The train took off like a bullet in 2009 when Attorney General Eric Holder announced that the U.S. Drug Enforcement Administration would essentially look the other way if state-approved dispensaries complied with local laws.

Today medical marijuana is a highly profitable industry. Precise customer numbers are elusive, but as acceptance spreads, the head count grows. To obtain a medical marijuana card, patients have to be diagnosed with an approved condition by a licensed physician and register with the state.

Once their doctor writes a prescription, users can enter a marijuana emporium, offering a dizzying array of cannabis strains as well as new delivery systems, including electronic vaporizers, capsules, tinctures, teas, honeys, drinks and oils. Marijuana-infused food products, aka “medibles,” have expanded way beyond pot brownies to include pizza, pasta sauce, popcorn, ice cream, soda and even salad dressing.

This booming business, which was the subject of a recent Fortune cover story, is estimated to generate annual revenues of $36 billion — and that number is expected to double over the next five years.

Targeting the Boomer Market

This expanding market segment isn’t lost on marijuana cultivators, who are hybridizing varieties with particular appeal to users more interested in preventive health care and pain maintenance than catching a buzz. These strains are higher in the non-psychoactive cannabinoid CBD, which has anti-inflammatory properties and provides pain relief but doesn’t affect thinking and productivity.

Established players are using their business acumen to shape the industry. Former Microsoft manager Jamen Shively (aka “the Bill Gates of Cannabis”) recently took things in a new direction when he opened Diego Pellicer, which bills itself as “the first legal retail brand in the United States focused exclusively on legal, premium marijuana for pleasure and creative pursuits.” Shively has said that he’s specifically appealing to “baby boomers with disposable incomes who smoked during college years but took a 30-year break to raise a family.”

Private equity firms are getting in on the action by strategically investing in the legal cannabis industry — and they’re targeting boomers. Michael Blue, co-founder of Privateer Holdings, says that midlifers represent about 40 percent of the visitors to his company’s first acquisition, Leafly.com, where “discerning connoisseurs who select cannabis strains like they select fine wines” can rate and compare marijuana.

A prime target: Zoe Helene, whose casual use is part of her holistic vegetarian lifestyle. She occasionally eats her husband’s “marjoons” (marijuana macaroons) to heighten her creativity, loosen up her body for dance and yoga, and help her grow spiritually.

“I’m not a pothead,” the boomer says. “For me, cannabis is a loving plant spirit that helps me understand myself. It heightens my senses and reminds me of higher levels of consciousness I can attain. And then I attain them, without it.”

Vermont Moves Toward Decriminalizing Marijuana

Vermont’s legislature on Monday approved a bill that would decriminalize the possession of small amounts of marijuana, a measure the state’s governor expects to sign into law in the coming weeks.

The move sets up the New England state to be the 17th in the United States to remove criminal penalties for having small amounts of pot. It does not go as far as Colorado and Washington, which in November became the first states to legalize possession, cultivation and use of marijuana by adults for recreational use.

Vermont’s House of Representatives on Monday gave final approval to a proposal to remove criminal penalties for adult possession of up to one ounce (28.3 grams) of marijuana and instead penalize with a civil fine, similar to a traffic ticket. Persons under age 21 caught with pot would be required to undergo substance abuse screening.

The House’s action upheld changes to the bill last week by Vermont’s Senate, including a provision that decriminalized possession of up to five grams of hashish, a potent pot derivative.

“I applaud the legislature’s action to decriminalize the possession of small amounts of marijuana,” said Vermont Governor Peter Shumlin. “Vermonters support sensible drug policies. This legislation allows our courts and law enforcement to focus their limited resources more effectively to fight highly addictive opiates such as heroin and prescription drugs that are tearing apart families and communities.”

A spokeswoman said the governor will sign the bill into law “within a few weeks.”

Currently in Vermont, possessing up to two ounces of pot is a misdemeanor punishable by up to six months in jail for a first offense and up to two years in jail for later offenses.

The measure was introduced in early February by state Representative Christopher Pearson of Burlington, with 38 co-sponsors from the Democratic, Republican and Progressive parties. A similar proposal also was introduced in the Senate.

The latest proposal is similar to “decriminalization” laws in California, Connecticut, Maine, Massachusetts, Nebraska, New York, Oregon and Rhode Island, where private, non-medical possession of marijuana is treated as a civil, non-criminal offense, said NORML, a group that supports marijuana legalization.

Five other states — Minnesota, Mississippi, Nevada, North Carolina and Ohio — treat marijuana possession as a fine-only misdemeanor offense, NORML said.

Alaska also imposes no criminal or civil penalty for the private possession of small amounts of marijuana, after action by its state Supreme Court, said NORML.

Vermont already had legalized pot for medical use in 2004.
