About Todd McCormick: McCormick spent most of his young life in the children’s ward of Rhode Island Hospital battling Histiocytosis X, a rare form of cancer. When he was nine, his mother chose to give him cannabis as anti-nausea to help with side-effect of his treatment, which had amazing results for him.

McCormick began cultivating his own medicine in 1984, which was the beginning of a new career in cannabis—-one that has taken him around the world advocating for its benefits. Cannabis legislation has been all over the news lately. New York just became the twenty-third state to legalize medical cannabis, and a day later, Washington state’s first recreational marijuana dispensaries opened their doors. “Cannabis laws vary tremendously from state to state, and they have been changing faster than ever in recent years,” says John Malanca, founder and owner of United Patients Group, a trusted advocate and news source for medical cannabis patients. “We wanted to give a comprehensive overview of where each state stands and where each state is headed.”

Colorado and Washington are currently the only two states that regulate and tax recreational cannabis use. Since the law went into effect on January 1, Colorado has collected $ 11 million in tax revenue to fund education. Washington dispensaries opened on Tuesday, and the state is expecting to reap millions in taxes to fund its healthcare plan and the General Fund.

Three state legislatures passed medical marijuana bills this year: Minnesota on May 30, Maryland on June 1, and New York on July 5. This brings the total number of states that allow legal access to medical cannabis up to twenty-three states plus Washington, DC.

“It has been an incredible year for medical cannabis—and the year is only half over!” exclaims Malanca. “As more people become educated about the benefits of cannabis for treating a wide array of serious ailments, it becomes impossible to deny patients access to the medicine that helps them most.”

Even conservative states that have remained staunchly anti-cannabis have started to relax their stance a bit. This year, eleven states approved the use of a non-psychoactive cannabis derivative, CBD oil, to treat childhood epilepsy. After an affecting series of reports by Dr. Sanjay Gupta on CNN about how this oil was the only medicine that worked for a group of children with severe epilepsy, governors in Alabama, Florida, Iowa, Kentucky, Mississippi, South Carolina, Tennessee, Utah and Wisconsin signed bills that allow its use. Legislatures in Missouri and North Carolina have approved similar bills, and the governors are expected to sign them soon.

“We applaud these states for recognizing that these children deserve access to medicine that makes an incredible difference to their seizures. We want to point out, however, that many parents find medicine that has more THC in it to be even more effective,” notes Malanca. “And while CBD oil helps with epilepsy, different strains and extracts of cannabis are effective at treating other diseases—including cancer, Alzheimer’s, fibromyalgia, depression, and many others. All patients in these states deserve full access to medical cannabis.”

Looking to the rest of 2014, United Patients Group sees promising activity all over the country. This November, voters in Alaska, DC, and Oregon will have the opportunity to legalize recreational cannabis, which will be regulated and taxed similarly to Colorado and Washington. Voters in Florida will have the opportunity to legalize medical cannabis.

State legislatures are working on cannabis laws, too. This session, many states have considered or are considering legalizing medical marijuana, treating cannabis like alcohol, reducing penalties for marijuana possession, and allowing industrial hemp.

Malanca concludes, “It’s heartening to see that so many states are taking steps to change their unjust cannabis laws, but we still have a lot of work to do to make sure that all Americans can have safe, legal access to the medicine they need.”

A Brief History of Sacramento Medical Marijuana

According to history books, during the late years of 1970’s, cannabis patient named Mr. Robert Randall sued the federal government for arresting him for using medicinal cannabis to treat his glaucoma. He won the case and with this, the presiding judge ruled that Randall should use cannabis for health purposes and required the Food and Drug Administration (FDA) to set up a program to allow cultivating, growing, purchasing and even selling cannabis.

The judge asked the FDA to allow growing this cannabis on a farm at the University of Mississippi and to distribute 300 cannabis cigarettes a month to Randall. Meanwhile, after several years, in 1992 to be exact, US President George H. W. Bush put an end to the program after the patient, Mr. Randall tried to make AIDS patients qualified for the said program as well.

Initially, there are thirteen people were already enrolled and were allowed to continue sniffing medical cannabis cigarettes to cure their medical conditions, then few years later, the US government just shipped medical cannabis cigarettes to merely seven medicinal cannabis patients. One cannabis patient named, Mr. Irvin Rosenfeld, who during those years has received medical cannabis attention from the program since 1982 to treat his rare bone tumors, urged the George W. Bush administration to reopen the program; however, in the end he was not successful though.

During those times, the state of Alaska is the only state in the United States where possession of up to one ounce is legal. Sacramento back then was not allowed to use this medical cannabis even as an alternative medicine to cure diseases.

Medical experts in Sacramento cited the dangers of cannabis even for medical purposes. They added that the lack of clinical research supporting its medicinal value to heal various medical conditions. Meanwhile, the American Society of Addiction Medicine (SAM) in March 2011 issued a white paper recommending a halt to using marijuana as a medicine in US states where it has been declared legal. But medical patients in the Sacramento region, who has been cured by this medical cannabis, beg to disagree about the proposal done by the (SAM). Employers’ policies regarding workplace drug testing and employees’ cannabis use have recently fallen under question since Congress voted to end the federal ban on medical marijuana in December. In light of those questions, Novus Medical Detox Center analyzes the workplace implications of the policy change. The Florida drug detox facility emphasizes that under current law in most states, employers are still allowed to conduct drug testing and make hiring and firing decisions based on the results—regardless of whether a worker has a valid prescription for medical marijuana.

While the provision passed by Congress prohibits federal agents from prosecuting individuals who are buying or selling medical marijuana in accordance with state law, there are no federal restrictions on workplace policies concerning medical marijuana use. An employer’s right to enforce a drug-free workplace policy is left for the individual states to decide. So far, only a few states (including Arizona, Delaware and Minnesota) have statutes that prohibit employers from firing workers for a positive marijuana drug test if the employee holds a valid medical marijuana card; and in states without such prohibitions, the courts have generally ruled in favor of the employer. (1) Furthermore, because the federal government still classifies marijuana as a Schedule I drug, it must be treated as a prohibited substance in any workplace that is subject to federal regulations requiring drug testing of safety-sensitive workers or that receives federal funding. (2)

Novus previously analyzed the broader issue of substance abuse among American workers and found that drug use had a negative effect on employee productivity. Several studies have specifically explored the impact of marijuana use among workers and reported similar findings. One study noted that smoking cannabis impairs performance for a period of about four hours and presents an increased risk for injury or accidents when used before work or on the job. (3) Another study examined postal workers who tested positive for marijuana on a pre-employment drug test and found that they had 55% more industrial accidents, 85% more injuries and a 78% increase in absenteeism compared to workers who tested negative for marijuana use. (4)

“Given that marijuana has been shown to have a negative impact on job performance and safety, employers have a legitimate concern regarding its use in the workplace,” said Will Wesch, Director of Admissions for Novus Medical Detox Center. “Businesses still maintain the right to conduct drug testing among workers and job candidates. And while a few states offer protections for people who hold a valid medical marijuana prescription, the majority of states do not. This means employers may terminate employment or rescind job offers for anyone who tests positive for marijuana use, and legal precedent has been on the employers’ side.”

According to the U.S. Drug Enforcement Administration, marijuana’s classification as a Schedule I substance means that it has “a high potential for abuse and potentially severe psychological and/or physical dependence.” (5) Wesch cautions that this potential for addiction may result in marijuana serving as a gateway to harder drugs: “Many people dismiss marijuana as a ‘soft drug’ and don’t see the harm in using it. But among the patients admitted to Novus for substance abuse treatment and detox, we’ve found that an overwhelming percentage of them started out using marijuana before graduating to cocaine, heroin, opiates or other illicit drugs.”

Wesch advises workers to be aware that marijuana use can jeopardize their employment, health and safety, and urges them to proceed with caution even in states when medical marijuana is legally permitted.
