The Canadian Cannabis Coalition (CCC), a national umbrella organization for stakeholders in cannabis-related organizations, products and services, applauds the visionary recommendations of the Special Senate Committee on Illegal Drugs, especially in regards to the legalization of cannabis. The report is a major advancement toward a harm reduction-based cannabis policy, which acknowledges that the harms and benefits of cannabis can best be dealt within a legal,

regulated and controlled environment.

Through rigorous research and analysis of the many models of drug policy practiced around the world, the Senate Special Committee has

acknowledged the failure of cannabis prohibition, which serves only to advance black-market criminal interests, while criminalizing a large

proportion of the population (around 600,000 Canadians currently have criminal records for personal possession of cannabis) for behaviour

that is not inherently dangerous to the self, or to others.

The CCC has been a vocal critic of the new Marijuana Medical Access Program. As such, it was of particular interest that the Senate Special Committee had many of the same concerns that we had long expressed. The Senate found that “The MMAR are not providing a compassionate framework for access to marijuana for therapeutic purposes and are unduly restricting the availability of marijuana to patients who may receive health benefits from its use”.

The recommendations and findings that are of particular interest to some of our members are:


Measures should be taken to support and encourage the development of alternative practices, such as the establishment of compassion clubs

No attempt has been made in Health Canada’s current research plan to acknowledge the considerable expertise currently residing in the

compassion clubs

Health Canada should, at the earliest possible opportunity, undertake a clinical study in cooperation with Canadian compassion clubs

The qualities of the marijuana used in those studies must meet the standards of current practice in compassion clubs, not NIDA standards

Consider viewing marijuana as a natural health product, like other herbs and plants

People who smoke marijuana for therapeutic purposes prefer to have a choice as to methods of use

Additionally, Health Canada has recently announced the formation of the long overdue Medical Marijuana Advisory Committee. Although the CCC boasts some of the most experienced and knowledgeable medicinal cannabis users, researchers, suppliers and pioneers in Canada, we have been denied representation on the committee.

While we applaud the Senate’s report for its compassionate and rational recommendations, we would like to point out some areas that could be improved:

The report calls for a declaration of amnesty for any person convicted of possession of cannabis under current or past legislation.

The CCC further recommends that amnesty be extended to anyone convicted of nonviolent growing and distribution cannabis offenses

under current or past legislation.

The CCC is opposed to any form of forced treatment for cannabis users. Those who are arbitrarily deemed excessive users must not be

forced to undergo treatment by a Drug Treatment Court or any other agency.

While the Senate shows great concern for the health of the many Canadians who use cannabis, these concerns could be better addressed

with attention to the quality standards of the cannabis being produced. Higher potency cannabis will lead to smaller amounts being consumed, and organically grown cannabis tested for molds, mildews and fungus will result in a healthier product being consumed. Such standards will greatly reduce any health risks associated with

cannabis use and will put the onus on the producer rather that on the consumer.

When considering cannabis use and driving, we suggest that impairment is the only valid concern as opposed to the operation of a vehicle under the influence of this substance if one is not impaired. Thus testing should be for impairment, not for substance use.

The CCC welcomes the Senate’s recognition that the label of “drug abuse” is arbitary and incorrect. At the same time, we do have concerns that some other language of the report, such as arbitrarily defining “at-risk” and “excessive” use at over and under one gram of consumption per day respectively, is counter-productive. Many

Canadians, particularly, medicinial users, consume in excess of several grams of cannabis per day without any harm to themselves or

others.

The recommended National Advisor on Psychoactive Substances and Dependency might better be called the Advisor on Psychoactive

Substances, until there is a better understanding of dependency and the connotation is less pejorative. The recommended national fund for

research on psychoactive substances should also fund research on the beneficial effects of such substances on humans.

Finally, on the same day that the Senate released its Final Report – September 4, 2002 – the DEA raided the most respected medical cannabis dispensary in the United States, The Wo/men Alliance for Medical Marijuana (WAMM); literally grabbing medicine out of the hands of the

sickest, weakest, most vulnerable of its citizens. In Canada, the last month has seen both the Toronto Compassion Centre (1200 members) and

the Sunshine Coast Compassion Society (70 members) raided by police, resulting in closure of the clubs. This callous, indefensible police

response to the suffering of some of Canada’s sickest citizens must also end.

To avoid further accusations of callousness or negligence, the government must act to implement the recommendations of the Special Senate Committee on Illegal Drugs with the CCC’s additions, immediately.

For our part, we will continue to press the issue through the criminal and civil courts, the political process, education via print, web and

electronic publishing, and civil disobedience, until the situation is remedied.

Canada is a modern, educated, and compassionate country; it is time for our drug laws to reflect logic and common sense. It is time to end

the war on responsible Canadian cannabis users. It is time for a drug peace.

Hemp Seed – Too Good For Australians to Eat

Locally established hemp distributor, Planet Hemp Products, exported Australian grown and processed human-grade hemp food to China this week.

Planet Hemp Products is the first company in Australia to export hemp food to China. For many years, China has been one of the largest producers and exporters of hemp seed and hemp fibre products in the world.

“It is a credit to the Beattie Government practices, persistence and AusTrade that we are in a position to begin competing in such a sustainable agricultural industry”, said Thomas, general manager of Planet Hemp Products.

The first commercial industrial hemp crops were sown in Queensland in 2002. In that same year, the Food Standards Australia New Zealand (FSANZ) recommended that the Australian Health Council approve hemp seed foods for human consumption. For the first time in Australian history, the Health Council of Australia has ignored a FSANZ recommendation leaving Australia as the last western democracy in which hemp seed foods for humans remain controlled by State Criminal legislation.

The only hemp foods currently available in Australia are for our pets. Ironically, the Australian made pet food contains the same Australian hemp seeds contained in human grade food that Planet Hemp Products now exports.

Planet Hemp Products began working with Austrade offices in London, New York, Los Angeles, Toronto, Vancouver and Tokyo late last year to introduce Australian made hemp foods to the world.

Hemp seed does not contain any THC, the drug; it is a superior source of easily digestible and complete proteins, dietary fibre and the good fats – omega 3 and omega 6. Hemp as an agricultural crop is environmentally and commercially sustainable to grow in many parts of Australia.

Due to the legal restrictions in Australia, Planet Hemp Products was inadvertently lead into the pet food industry. It was a decision that would change the face of the Australian hemp food and pet food industries forever as Planet Hemp Products began exporting its range of Dr Skoobie’s Snax and Superior Health Choice dog kibble earlier this month to the USA.

Planet Hemp Products are a family owned company that began in 2004 when they executed the largest hemp seed contract in Australia. In 2007, Hemp seed production will have increased by over 1,000% with licensed crops in Queensland, Tasmania and Victoria.

“We are now in discussions with the largest and best hemp seed processor in north America to gain the use of their processing experience. We have also discussed supplying Canada and the USA with Australian grown hemp seed by-products in their cold season,” said Thomas.

The Federal Government is reluctant to change the status quo regarding hemp seed foods in Australia for people. One of the stated reasons is that it will confuse the Australian public.

This new situation is creating more confusion as many informed Australians are wondering why it seems everyone else can benefit from hemp seed foods, except them. Even our cousins across the Tasman are permitted to consume hemp seed oil.

In November of 2009 The American Medical Association (AMA) issues a resolution that asks the Federal government to review the restrictions on medical marijuana in order to ease the way for more research.

In March of 2011 the first real market data of the medical cannabis industry’s economic power was released by See Change Media and the National Cannabis Industry Associations first lobbying day on Capitol Hill – citing domestic sales of medical marijuana to be 1.7 billion dollars.

As of 2011 there are 15 compassionate states and D.C. who have passed and are implementing their compassionate use legislation, with dozens of more states considering initiatives for their states future health and economies.

The time has come to celebrate the 420 Holiday responsibly by integrating holistic health, environment and the precepts of Earth Day into the conversation. It’s the dawning of a new age and the medical cannabis revolution is upon us.

Steward Bags Owners Launch New Fundraising Initiative to Combat Global Plastic Bag Problem

An average of 100,000 plastic bags are handed out every minute, totaling billions of plastic bags consumed worldwide each year. Most single use plastic bags are employed for 20 minutes then thrown in the trash. Reusable cotton produce bags, such as Steward Bags, can be washed, used for numerous years, and composted. Owners of Steward Bags are proud to make their reusable produce bags available to school and community “green fundraising”.

Since its introduction in the 1950s, the plastic bag has become a story of innovation gone wrong. The grocery and retail industries adopted the plastic bag due to its light-weight, high-load capacity and cheap price. Few anticipated that its popularity would create serious global environmental concerns.

Plastic bags dumped in the landfill can take up to 1000 years to breakdown. In the process they separate into small toxic particles that contaminate soil and water. In many countries plastic bags have become a primary source of litter. In South Africa for example, plastic litter is so omnipresent the plastic bag is referred to as the national flower (National Geographic News).

The world wide use of the plastic bags has led to an increase of plastic waste floating in the oceans. The “Garbage Patch ” or “Trash Vortex” floating in the North Pacific Ocean continues to grow since its discovery by the National Oceanic and Atmospheric Administration in 1988. Current estimates of its size range from 700,000 square kilometers to more than 15,000,000 square kilometers (Wikipedia).

Plastic bags often strangle, choke or starve marine life. Floating bags move through the water, taking on a lifelike appearance. Swallowed plastic is not digested. It causes obstructions, stops food intake, and results in starvation. When marine animals die and their bodies decompose, any plastic they have ingested is released back into the water (National Geographic News).

People are becoming more aware of the environmental threats caused by plastic bag waste and are inspired to move towards effective solutions. Government organizations, environmental groups, scientists and new eco-businesses are taking steps to address this world wide problem.

Organized Government Initiatives

Plastic bags have been banned or restricted in more than 25% of the world. Countries such as Kenya, Uganda, China, India have passed legislation restricting the thickness of plastic bags manufactured. Some countries that have banned plastic bags all together are Belgium, Bangladesh, Rwanda, Tanzania, Ireland and Italy. Some bans have been initiated at municipals level in countries such as Canada and USA (National Geographic News).

Taxes or levies have also been introduced by the government in many countries such as Israel, Hong Kong, Germany and Canada to discourage the overuse of plastic bags. The levies collected are used to pay for recycling facilities and clean up of plastic bag litter.

Recycling/Reusing/ Biodegradable Plastics

Recent studies suggest that approximately 20% of plastic bags are reused for garbage and pet waste. After “reuse” they end up in the landfill. Bag recycling has also increased in the past decade. However, most municipal recycling facilities are not equipped to recycle plastic bags and the process takes a fair amount of energy (Wikipedia).

Biodegradable plastic such as bio-plastics and petroleum-based plastics have become more mainstream. Regrettably, they require a significant amount energy to produce and a specific environment for biodegradation. Carbon and methane are released into the atmosphere as greenhouse gases when oil based materials degrade. Starch based bio-plastics, may be almost carbon neutral, but they can have a damaging effect on soil, water usage and quality (Wikipedia).

Alternative Products

One of the simplest and most effective solutions introduced is the reusable grocery bag. Reusable bags are now widely available and used by grocery shoppers. Many of the original recycled plastic designs are difficult to wash and as a result can harbor growing bacteria. Washable reusable bags made out of natural biodegradable cloth fibers such as organic cotton, jute and hemp have recently been introduced.

Two teachers from Canada recognized the need for reusable bags to replace the flimsy plastic bags that hold loose fruits and vegetables. They created a washable bag made of organic cotton netting, certified by the Global Organic Textile Standards (GOTS). After 3 to 4 years of use, this reusable produce bag can be composted. IRS Threatens to Shut Down Medical Cannabis

The IRS threatens to turn back the clock on medical cannabis. A national alliance of industry leaders, patients and elected officials are fighting back with a new project aimed at education and policy change. The 280E Reform effort plans to bring an end to the current IRS campaign to close medical cannabis dispensaries.

The IRS campaign of aggressive audits was launched approximately 2 years ago and uses section 280E of the IRS code to deny dispensaries the ability to deduct legitimate business expenses. Denied expenses include items such as rent, payroll, and all other necessary business expenses.

These denials result in astronomical back tax bills for the affected dispensaries that, if not changed, threaten to destroy the financial viability of every medical cannabis dispensary in the country—thereby ending safe and affordable access to cannabis for legally qualified patients.

Section 280E was passed by Congress in 1982, long before the passage of medical cannabis laws and was intended to apply to traffickers of dangerous drugs. Last year, Congressman Pete Stark (D-CA) introduced the Small Business Tax Equity Act (H.R. 1985), which would create an exception to 280E for legal medical marijuana businesses, allowing them to take the full range of business expense deductions on their federal tax returns.

With fear looming that these audits will eventually shut down all legally operating medical cannabis businesses that have been operating according to their state laws—and some paying taxes for years—time is of the essence.

Campaign spokesperson Steve DeAngelo outlined the consequences: “Should the IRS campaign be successful, it will throw millions of patients back in to the hands of street dealers, eliminate tens of thousands of well-paying jobs, destroy hundreds of millions of dollars of tax revenue, enrich the criminal underground, and endanger the safety of communities in the 17 medical cannabis states.”

In response to these dangers, the 280E Reform project is announcing a nationwide campaign to bring awareness to legislators, provide legal and tax counsel for threatened organizations and prepare a grassroots educational effort to enlighten the public on the need to reform 280E.

“We are going to challenge this tax code to make sure that patients all over America have the ability to safely fill their health care needs with safe access from medical cannabis providers who are operating clearly with state laws,” said lead tax attorney Henry Wykowski. “This is a public safety issue and a healthcare right.”

An impressive team has been assembled to lead this effort, including Don Duncan, co-founder of American for Safe Access (ASA) and medical cannabis supporter who has been featured on 60 minutes, Dan Rather Reports and the LA Times; Henry Wykowski, legal tax counsel who successfully defended CHAMP in a similar IRS audit; Troy Dayton, co-founder of Students for Sensible Drug Policy (SSDP), former Senior Development Officer of the Marijuana Policy Project (MPP) and current CEO of ArcView Group; Amir Daliri, entrepreneur and co-founder of California Cannabis Association and President of CannLobby, LLC, a medical cannabis focused political consultancy; and Steve DeAngelo, Executive Director of Harborside Health Center and activist, whose accomplishments include the passage of Proposition 59, the Washington D.C. medical cannabis initiative.

A graduate of the University of Maryland (summa cum laude), DeAngelo is a charter member of Americans for Safe Access and co-creator of Hemp Tour and Ecolution Inc., which produced hemp garments and accessories. He is the star of the new Discovery Channel series “Weed Wars.”

Now you have everyone looking for investment opportunities in an industry that’s soaring.”

How would the legalization of marijuana benefit the American people and the economy? Industry analysts believe there will be a creation of a new and highly profitable agricultural industry, increased trade opportunities, an increase in the gross national product (GNP), improved environmental conditions, new tax resources, and reduced costs with respect to enforcement of current laws. National Marijuana Business Conference 2012 to Host Dixie Elixirs President Tripp Keber
